This promotional competition ("Competition") is organised by Panga Panga Furniture Manufactures CC (registration number 2001/045200/23) of Shop 3 – 4 Builders Warehouse Centre Nobel Street, the Interchange, Somerset West, 7130 (the "Promoter").

Duration. The Competition commences at 08h30 on 1 August 2019and ends at 23h59 on 25 February 2020, both days inclusive. 

Prize. The prize in this Competition is R100,000.00 (one hundred thousand Rands) (inclusive of VAT) worth of Panga Panga leather furniture (the "Prize"). The Promoter will, at its sole discretion and subject to availability, make various styles of Panga Panga leather furniture available for the Prize winner to select the Prize from. The Prize does not include any delivery or associated costs, which are for the winner's personal account. In the event that the winner wishes to make any changes or additions to the Prize, all such changes and/or additions will be for the winner's personal account. 

Eligible participants. The Competition is open to persons who are permanent residents and citizens of South Africa over the age of 18 (eighteen) years and in possession of a valid South African identity document, or if under the age of 18 (eighteen) years when entering the Competition, with the consent of a parent or legal guardian, and any juristic persons registered in terms of the laws of South Africa, with valid registration documents and represented by an authorised individual with a valid South African identity document ("Participant").

Disqualified persons. The Competition is not open to any employee, director, member, partner, agent or consultant or any person who directly or indirectly controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, their advertising agencies, advisers, dealers, suppliers, affiliates and/or associated companies.  

Agree to the Rules. By entering the Competition, all Participants and winners, including the parent or legal guardian of a minor Participant or authorised individual on behalf of a juristic person Participant, agree to be bound by the rules set out in this document ("Rules") as interpreted by the Promoter, whose decision regarding any dispute in respect of the Rules will be final and binding. 

Changes to the Rulesor Competition. The Promoter may at any time without notice, amend, change, modify, postpone, suspend or cancel the Rules, the Competition or any Prize (which has not yet been subject to a draw) for any reason which the Promoter reasonably deems necessary. 

Entry into the Competition

To be entered into the Competition, Participants must spend a minimum of R20,000.00 (twenty thousand Rand) (inclusive of VAT) on Panga Panga leather furniture, purchased directly from the Promoter. Participants will qualify for 1 (one) entry into the Competition per R20,000.00 (twenty thousand Rand) (inclusive of VAT) spent on Panga Panga leather furniture per transaction. Spends towards delivery or other costs associated with the purchase of Panga Panga leather furniture will not count towards the qualifying spend amount. 

Upon completing a qualifying purchase, the Participant will be presented with a form to complete in order to be entered into the Competition. The Participant is required to complete the entry form in full, together with a copy of the receipt of purchase, and deposit the entry form with the Promoter. The Participant must retain a copy of the receipt of purchase as evidence of their entry and, if selected as the Prize winner, present it to the Promoter in order to receive the Prize. 

To be clear: If a Participant spends R50,000.00 (inclusive of VAT) on Panga Panga leather furniture, the Participant will be eligible for 2 (two) entries into the Competition and will be required to complete 2 (two) entry forms. If a Participant spends R40,000.00 (inclusive of VAT) with the Promoter, but R35,000.00 is for Panga Panga leather furniture and R5,000.00 of the spend is in respect of delivery costs, the Participant will only be eligible for 1 (one) entry into the Competition. 

Any qualifying purchases that have been returned or otherwise cancelled by the Participant will be disqualified, the corresponding entries cancelled and will not be eligible to receive the Prize. 

Selecting the winner

All valid entries received by the Promoter for the duration of the Competition will be eligible to receive the Prize. Any incomplete entries or entries in respect of a qualifying purchase that has since been returned will not be valid and will not be eligible to receive the Prize. 

The Promoter will conduct a random draw from all eligible entries received during the Competition period on 28 February 2020. The winner will be selected from the eligible entries by an independent person as required by the Consumer Protection Act 68 of 2008 (the "CPA"). The Promoter's decision is final, and no correspondence will be entered into. 

The Promoter will contact the winner telephonically to inform them that they have been selected as the Prize winner.

The winner will be required to present the following to the Promoter within 10 (ten) working days of being notified as the Competition winner in order to be confirmed the winner and receive the Prize – 

  • completed prize winner declaration form made available to the winner by the Promoter;
  • positive identification to the Promoter (copy of identity document/passport/registration documents) as detailed on the prize winner declaration form; and
  • copy of the receipt of purchase corresponding to the winning entry.

If the Promoter is unable to reach the Prize winner after 2 (two) working days from the draw taking place or if the Prize winner fails the verification process or is found to be in breach of the Rules, a replacement winner will be selected from the remaining valid entries, following which the same verification process will be followed. This process will continue until a final winner is selected and verified. 

Redeeming the Prize

Upon completing the required verification process, the winner will be required to redeem the Prize within 2 (two) calendar months of being notified as the winner.

Publicity of the winner 

The Prize winner will be given the opportunity to agree to the publication of their name on the Promoter's website and on other media for advertising purposes. The winner may also be requested to have their image published and/or to participate in marketing activities, but the winner may refuse either such requests.

General terms and conditions 

Right of admission. The right of admission into the Competition rests solely with the Promoter. 

Costs and expenses. The Promoter will not be liable for any costs or expenses incurred by the winner in relation to the Prize or the use thereof, including any delivery or other costs involved in redeeming the Prize. 

Representations. The Promoter makes no representations and gives no warranties, whether expressly or implicitly, as to the Prize and makes no representations and gives no warranty that an entry will necessarily result in the Participant winning the Prize or that the Prize will be satisfactory, punctual, free from any defects, safe or reliable. 

Limitation of liability. Subject to applicable law, the Promoter will not be responsible for any harm, damage, loss or claim relating to the provision of any element of the Prize or any changes to the Prize that may be made at any time. The Promoter is not liable for any defects in the Prize. Ownership of and risk in the Prize will pass to the Prize winner upon delivery thereof.

Prize limitations. The Prize is not transferable to another person and may not be deferred unless agreed to by the Promoter in writing. The Prize is not redeemable for cash. The Promoter reserves the right to substitute the Prize with any other prize of comparable commercial value. 

Taxes. The value of the Prize includes VAT, and the Prize winner will be liable for any tax imposed in terms of applicable tax legislation. 

Tax Implications. The Promoter recommends that Participants obtain independent professional advice regarding any tax implications arising from the receipt, transfer or spend of any Prize obtained as a result of this Competition. The Prize winner is responsible for any tax implications arising from or associated with any receipt, transfer or spend of any Prize due to their participation in this Competition. The Prize winner agrees that they will not the Promoter or any of its directors, members, employees, service providers or other related parties liable, and the Prize winner hereby indemnifies and holds the Promoter harmless against all damages, claims and fines made against the Prize winner or the Promoter, including all legal costs, to the extent to which such damages, claims and fines arise out of or are connected to any taxation relating to the receipt, transfer or spend of any Prize or the charges in respect thereof as a result of this Competition.

Indemnity. Participants agree to indemnify the Promoter for any loss or damage a Participant suffers because they took part in the Competition or used the Prize and indemnifies the Promoter for any loss that the Promoter suffers due to the Participant breaching the Rules.

Marketing. By entering the Competition, the Participants agree that the Promoter may contact the Participants via email and/or through social media platforms with marketing communications regarding the Promoter's products and promotional activities. Participants will be able to opt-out of receiving marketing communication with every marketing communication.

Content. Participants agree and consent that by posting any content on any social media platform in relation to the Competition, the Participant gives the Promotor a worldwide, royalty free and non-exclusive license to use, modify and re-publish any such content for the purposes of promoting the products and services of the Promotor.

Personal Information. By entering the Competition, Participants agree to the Promoter processing their personal information for purposes of administering the Competition and acknowledge that the Promoter will retain their personal information for the periods required by applicable laws.
